TERMS AND CONDITIONS OF SALE

1 – Scope and definitions

These terms and conditions of sale apply to all transactions made via this website: users of the website must, before any purchase, have read and accepted them.
The term “user” refers to any internet user who navigates on this website; the user who buys and pays for a service becomes a “customer”.
A service corresponds to a tour on a given day and at a given time.
The "Bus & Boat" product combines a FOXITY service and a Vedettes de Paris cruise

2 – Purchase method

The prices featured on this website are given in euros and are inclusive of taxes.
The website user must firstly choose the service he/she would like to use: the total price (depending on the total number and type of passengers) is displayed for the various tours available to purchase.
After acceptance of these terms and conditions, the user pays by bank card using the secure payment system made available on the website.
As soon as the payment is confirmed, an email will be sent to the address given by the user, along with a corresponding exchange voucher: the customer must print it out on a printer, as he/she must present it to FOXITY or any other service provider in order to benefit from the purchased services.
No other document will be accepted as proof of purchase (bank statement, etc.) This document summarises the main elements of the order: name and address of the customer, date and time of the tour, number and type of passengers.

3 – Access on board

Access on board the FOXITY buses and on board the boats is only permitted on presentation of an exchange voucher sent via this website: some form of identification may be requested to check that the person in possession of the voucher is indeed the purchaser, or as proof of eligibility for any reduction.
No child under 12 years of age will be accepted on board without being accompanied by an adult, even if he/she is in possession of a valid ticket.
The exchange vouchers will be kept by the FOXITY operator after the service has been provided.

4 – Cancellation / cancellation fees

The tickets cannot be exchanged or reimbursed.
FOXITY declines any liability in the event of the loss or theft of the exchange vouchers. Similarly, any curtailment of the tour on the customer’s request shall not give rise to any reimbursement whatsoever.
FOXITY draws its customers’ attention to the fact that no cancellation insurance is included in the proposed prices.
If, for reasons outside its control, and particularly for safety reasons, FOXITY is obliged to modify or remove one or several tours, it undertakes to defer the initial reservation to another tour, in agreement with the customer or if this is not possible, to reimburse the total cost of the service: no additional damages may be claimed by the customer.

5 – Liability

Neither FOXITY nor its partners shall be held liable for the return or not of objects or personal effects left on board the vehicles: each passenger must check before getting off that he/she has not left anything on the bus after the tour.
The customer is responsible for the information that he/she gives when purchasing services on the website: in the event of an error, he/she should contact FOXITY in order to rectify it.
FOXITY reserves the right to cancel or modify some tours in the event where the safety of passengers is compromised, as well as in the event of a strike or demonstration.

6 – Safety

Passengers are expected to familiarise themselves with the on-board safety rules: they must fasten their seat belt, ensure that children do the same and refrain from leaning out of the bus, stretching out their arms or throwing anything over the guardrails,...
If passengers have any doubts or additional questions, they should ask the FOXITY staff or drivers.

7 – Applicable law

The applicable law for transactions made via the FOXITY website is French law. Any dispute which may arise from a transaction made on this website shall fall under the jurisdiction of french courts.
